The conference aimed to present the effect of the ruling on jurisdiction in favour of the majority of Yukos shareholders v the Russian Federation in the EU-Russia energy relationship.

Dr Scherer reviewed the current issues and the merits. If a ruling is obtained in favour of Yukos, will it be unenforceable in Russia? Could it be enforced outside Russia? Could the Russian state rely on sovereign immunity to discourage the bringing of any effective legal claims? What are the effects of the decision of the federation of Russia to withdraw from provisional application of the ECT on October 19th 2009?

Does this decision repine the EU-Russia energy Relationship from the EU side or on the Russian side? What are the effects of this decision on the European companies involved in energy investments in Russia (ie BP, Shell, Total, RWE, E.ON)? What are Russia's needs in terms of foreign investments and of transit access to the European Market? What kind of international energy contracts exist between the EU & Russia?
